Terms of Service

1. Acceptance of Terms

By creating an account or using AIdorable ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We may update these Terms from time to time — continued use after changes constitutes acceptance.

2. Eligibility

AIdorable is designed for users aged 18 and older. By using the Service, you represent that you are at least 18 years of age. If you are between 13 and 17, you may use AIdorable only with verifiable parental or guardian consent and supervision. Users under 13 are not permitted to use AIdorable.

3. The Service

AIdorable is a digital companion application where you adopt and care for a virtual baby that develops a unique personality over time through your interactions.

AI-Generated Content:Your baby's responses, personality, emotions, and behaviors are generated by artificial intelligence. Your baby is not a real person, not sentient, and not capable of genuine emotion. The companion experience is designed to feel personal and engaging, but it is a software simulation.

Not a Substitute for Professional Help: AIdorable is an entertainment product. It is not a therapist, counselor, medical professional, or substitute for human connection. If you are experiencing mental health difficulties, please reach out to a qualified professional or crisis service.

4. Your Account

• You are responsible for maintaining the security of your account credentials
• You are responsible for all activity that occurs under your account
• You must provide accurate information when creating an account
• One person may create one account (multiple accounts are not permitted)
• You may not transfer or sell your account to another person

5. Free & Premium Plans

AIdorable offers a free tier and a premium subscription plan:

• Free: One baby, basic interactions, limited features
• Premium: Up to three babies, memory journal, AI-enhanced features, exclusive store items, and priority support

We reserve the right to modify the features included in each tier. We will notify existing subscribers of material changes to their plan.

6. Payments & Subscriptions

• All payments are processed securely through Stripe. By making a purchase, you also agree to Stripe's terms of service.
• Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. You can cancel your subscription at any time through your account settings.
• Store purchases (outfits, toys, themes) are one-time purchases and are non-refundable once the digital item has been delivered to your account.
• Refunds: Subscription refunds may be requested within 7 days of the most recent charge by contacting us. We evaluate refund requests on a case-by-case basis. Store item purchases are non-refundable.
• All prices are displayed in USD and include applicable processing fees. Prices may change with notice.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to manipulate, exploit, or reverse-engineer the AI systems
• Submit content that is abusive, hateful, threatening, or harmful through the chat feature
• Use automated scripts, bots, or scrapers to access the Service
• Attempt to gain unauthorized access to other users' accounts or our systems
• Resell, redistribute, or commercially exploit the Service without permission
• Circumvent or interfere with security features of the Service

8. Your Content

When you interact with AIdorable (naming your baby, sending chat messages, creating journal entries), you retain ownership of the content you create. By using the Service, you grant us a limited license to store and process your content solely for the purpose of providing and improving the Service.

We do not use your personal chat messages or journal entries for advertising purposes or share them with third parties except as described in our Privacy Policy.

9. Intellectual Property

AIdorable, including all software, design, artwork, animations, sounds, text, and branding, is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on AIdorable without our express written permission.

10. Service Availability & Changes

• We strive to keep AIdorable available 24/7 but do not guarantee uninterrupted access
• We may modify, update, or discontinue features at any time
• We will provide reasonable notice before discontinuing core features that affect paid subscribers
• Your baby's data is stored persistently — temporary outages will not delete your progress

11. Termination

We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or use the Service in a way that harms other users or our systems. You may delete your account at any time from your Profile page.

Account deletion removes your account, baby profiles, interaction history, chat messages, journal entries, inventory, and related app records, except limited records we must retain for legal, security, fraud-prevention, tax/accounting, dispute, or payment-provider obligations.

12. Limitation of Liability

To the maximum extent permitted by law, AIdorable and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to emotional distress from AI-generated content, loss of data, or service interruptions.

Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI-generated content will be accurate, appropriate, or error-free.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property violations.
